The article says that Capitulary of Quierzy was not a "legislative enactment" to prevent the King taking land from one family and giving it to another - and that is true. But is only true in the sense that hereditary land holding was accepted as a pre-existing old right. The point of the declarations was to accept that there were, unlike an old Roman Emperor, limits to the power of the ruler - that he could not, for example, change the doctrines of the church, or take land from one family and give it to another family.
